Dr. Whitney R. Leeman has issued 15 more 60-Day Notices of Proposition 65 violation against tea distributors, including Yamamoto of Orient, Eden Foods, and International Coffee & Tea.  Dr. Leeman alleges that the companies sold dried teas in California that contained the heavy metal lead without the requisite health hazard warning.  Lead is known to the State of California to cause cancer, birth defects, and/or other reproductive harm.

Leeman has issued more 60-Day Notices of Proposition 65 violation against tea distributors, including Ten Ren Tea Co., Starwest Botanicals, and Hsin Tung Yang Foods.  Dr. Leeman alleges that the companies sold dried teas in California that contained the heavy metal lead without the requisite health hazard warning.  Lead is known to the State of California to cause cancer, birth defects, and/or other reproductive harm.

Vinocur Issues New 60-Day Notices of P65 Violation

Laurence Vinocur has issued over a dozen new 60-Day Notices of Violation of Proposition 65 to companies offering products such as gloves with vinyl/PVC components, mugs with exterior designs, and hand tools in California that contain chemicals known to the State to cause cancer and/or reproductive harm without the requisite health hazard warning.  Vinocur alleges that the companies’ products contain the phthalate chemical DEHP, the phthalate chemical DINP, the flame retardant chemical TDCPP, and/or the heavy metal lead, which are known to the State of California to cause birth defects and other reproductive harm.  Noticed companies include Smart & Final Stores, Nordstrom, and Honeywell Enterprses.

Leeman Alleges Lead in Dried Teas

Leeman has issued 60-Day Notices of Proposition 65 to companies offering dried tea, both loose leaf and in bags, that were found to contain the heavy metal lead, without the requisite health hazard warning.  Lead is known to the State of California to cause birth defects and/or other reproductive harm.  The noticed companies include Teavana, Numi, and DavidsTea.

Moore Issues 6 New 60-Day Notices

John Moore has issued six new 60-Day Notices of Violation of Proposition 65 to companies offering products such as rainwear, table tennis paddles, and clothesline in California that contain chemicals known to the State to cause cancer and/or reproductive harm without the requisite health hazard warning.  Moore alleges that the companies’ products contain the phthalate chemical DEHP and/or the heavy metal lead, which are known to the State of California to cause birth defects and other reproductive harm.  Noticed companies include Riddell, Bon Tool Company, and Pitsco.

Held Files Complaint Against Sunscreen Manufacturers

Citizen enforcer Anthony E. Held has filed a complaint in Marin County Superior Court against Korres USA Ltd., LVMH Moet Hennessey Louis Vuitton, and Sephora, alleging that the defendants violated Proposition 65 by not providing health hazard warnings to consumers that a certain product contained benzophenone.  Benzophenone is a chemical known to the State of California to cause cancer, and companies offering products for sale in California that contain benzophenone are required to provide consumers with a "clear and reasonable" warning of the risk of exposure.

In addition to civil penalties, Dr. Held seeks an injunction to prohibit the defendants from selling the sunscreen in California without a Proposition 65 warning.

Dr. Leeman Pursues Enforcement Action Against Tea Manufacturers

Dr. Whitney R. Leeman has issued 60-Day Notices of Proposition 65 to companies offering dried tea, both loose leaf and in bags, that were found to contain the chemical naphthalene, without the requisite health hazard warning.  Naphthalene, which is best known as the main ingredient of traditional mothballs, is a chemical known to the State of California to cause cancer.  The noticed companies include Peet's Coffee & Tea, Samovar Tea Lounge, and Coffee Bean Direct.

Held Settles with Trimaco Re: DINP in Gloves

TCG client Dr. Anthony E. Held has negotiated a settlement with Trimaco regarding alleged violations of Proposition 65.  Held alleged that Trimaco sold vinyl/PVC gloves that contained the phthalate chemical DINP, which is known to the State of California to cause cancer, without the requisite health hazard warning.

In addition to paying civil penalties, Trimaco has agreed to reformulate its gloves sold in California to be free of DINP.

Leeman Files Complaint Against Perseus Books Re: Lead on Mugs

Dr. Whitney R. Leeman has filed a complaint against Perseus Books, alleging that the company violated Proposition 65 by selling mugs with exterior decorations that contained the heavy metal lead without a health hazard warning.  Proposition 65 requires that companies offering products for sale in California that contain chemicals known to the State to cause cancer, birth defects, and/or other reproductive harm--of which lead is one--must provide consumers with a "clear and reasonable" warning of the risk of exposure.

In addition to civil penalties, Leeman seeks an injunction to prohibit Perseus Books from selling mugs with exterior decorations without a Proposition 65 warning.
