Leeman Issues 15 Additional 60-Day Notices Against Dried Tea Distributors

Dr. Whitney R. Leeman has issued 15 more 60-Day Notices of Proposition 65 violation against tea distributors, including Yamamoto of Orient, Eden Foods, and International Coffee & Tea.  Dr. Leeman alleges that the companies sold dried teas in California that contained the heavy metal lead without the requisite health hazard warning.  Lead is known to the State of California to cause cancer, birth defects, and/or other reproductive harm.

Brimer Files Complaint Against Northern Brewer

Russell Brimer has filed a complaint in San Francisco County Superior Court against Northern Brewer, LLC, alleging that the company sold vinyl/PVC hoses and tools with vinyl/PVC grips that contained the phthalate chemical DEHP without the requisite health hazard warning.  DEHP is known to the State of California to cause birth defects and/or other reproductive harm, and Proposition 65 requires that companies offering products for sale in California that contain DEHP must provide consumers with a "clear and reasonable" warning of the risk of exposure.

In addition to civil penalties, Brimer seeks an injunction to prohibit Northern Brewer from selling the hoses and tools in California without a Proposition 65 warning.  Northern Brewer sells homebrew beer-making supplies and wine-making kits.

Englander Issues New 60-Day Notices of Prop65 Violation

Peter Englander has issued a dozen new 60-Day Notices of Violation of Proposition 65 to companies offering products such as gloves with vinyl/PVC components, headphones, and shower hoses in California that contain chemicals known to the State to cause cancer and/or reproductive harm without the requisite health hazard warning.  Englander alleges that the companies’ products contain the phthalate chemical DEHP, which is known to the State of California to cause birth defects and other reproductive harm.  Noticed companies include Ross Stores, Staedtler, and Ducati.

Vinocur Issues New 60-Day Notices of P65 Violation

Laurence Vinocur has issued over a dozen new 60-Day Notices of Violation of Proposition 65 to companies offering products such as gloves with vinyl/PVC components, mugs with exterior designs, and hand tools in California that contain chemicals known to the State to cause cancer and/or reproductive harm without the requisite health hazard warning.  Vinocur alleges that the companies’ products contain the phthalate chemical DEHP, the phthalate chemical DINP, the flame retardant chemical TDCPP, and/or the heavy metal lead, which are known to the State of California to cause birth defects and other reproductive harm.  Noticed companies include Smart & Final Stores, Nordstrom, and Honeywell Enterprses.

Moore Files Complaint Against U.S. Jaclean

John Moore has filed a complaint in Alameda County Superior Court against U.S. Jaclean, alleging that the company sold exercise balls that contained the phthalate chemical DEHP without the requisite health hazard warning.  DEHP is known to the State of California to cause birth defects and/or other reproductive harm, and Proposition 65 requires that companies offering products for sale in California that contain DEHP must provide consumers with a "clear and reasonable" warning of the risk of exposure.

In addition to civil penalties, Moore seeks an injunction to prohibit U.S. Jaclean from selling the exercise balls in California without a Proposition 65 warning.

Moore Settles with Maverick Apparel

John Moore has negotiated a successful settlement with Maverick Apparel, resolving allegations that the company sold vinyl/PVC jackets that contained the phthalate chemical DEHP without the requisite health hazard warning.  DEHP is known to the State of California to cause birth defects and/or other reproductive harm, and companies offering products for sale that contain DEHP must provide consumers with a Proposition 65 warning.

As a condition of the settlement, Maverick Apparel has agreed to sell vinyl/PVC jackets in California that have been reformulated to be virtually free of DEHP.

Mars Retail Group Recalls M&M-Branded Jewelry

The Mars Retail Group has issued a recall on M&Ms-branded jewelry that were sold at M&Ms World Stores in New York; Orlando, Fla.; Las Vegas; and Henderson, Nev. from May 2015 to June 2016.  The jewelry has found to contain high levels of lead, in excess of federal safety standards.

The recalled jewelry includes earrings, rings, bracelets, and necklaces featuring the M&Ms "M" logo as a charm or other feature.  Consumers are urged to stop using the jewelry immediately, place out of reach of children, and contact M&Ms World for a full refund.

Lead is a chemical known to the State of California to cause cancer, birth defects, and other reproductive harm.  Under Proposition 65, companies offering products for sale that contain lead must provide California consumers with a warning of the risks of exposure.
