A Consent Judgment in the As You Sow v. A.W. Chesterton Company, et al. matter, heard in the San Francisco County Superior Court, was entered on December 18, 1995. The Consent Judgment resolved private enforcer As You Sow's allegations that defendant A.W. Chesterton Company ("AW") sold paints and solvents containing nickel and nickel compounds, toluene and perchloroethylene (hereinafter "products") in the State of California without providing the requisite health hazard warnings.

As part of the settlement, AW agreed not to knowingly sell in California products unless such products contain health hazard warning labels as prescribed in the Consent Judgment.

The Consent Judgment required restitution payments of $1,500 made pursuant to Business & Professions Code section 17203, made to As You Sow Proposition 65 Enforcement Fund and settlement payments of $6,000 to whistleblower As You Sow and their counsel for the successful enforcement of this matter in the public interest.
